These Terms of Use ("Terms") govern your access to and use of Pocket Med's mobile applications, website, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account, unless a parent or legal guardian provides consent where permitted by law. You represent that the information you provide is accurate and complete.

2. Nature of the Services

Pocket Med is a technology platform that facilitates connections between patients and independent healthcare providers. Pocket Med does not provide medical care, diagnosis, or treatment. Licensed providers are solely responsible for clinical decisions and professional services delivered through the platform.

Emergency situations: The Services are not for emergencies. If you are experiencing a medical emergency, call your local emergency number immediately.

3. Accounts and Security

You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Notifying us promptly of unauthorized access

We may suspend or terminate accounts that violate these Terms, pose security risks, or are subject to administrative action for abuse or fraud.

4. Appointments, Payments, and Subscriptions

Fees for consultations, subscriptions, and other services are displayed before you confirm a transaction. Payments are processed through third-party payment providers. Refund and cancellation policies may vary by service type and are disclosed at the time of purchase.

5. Provider Relationships

Providers using Pocket Med are independent professionals and not employees or agents of Pocket Med. Your relationship with a provider is between you and that provider. Pocket Med does not guarantee availability, outcomes, or suitability of any provider.

6. Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, or fraudulent purposes
  • Harass, threaten, or abuse other users or providers
  • Attempt to access accounts or systems without authorization
  • Upload malware, scrape data, or interfere with platform operations
  • Misrepresent your identity or medical information

7. Intellectual Property

The Services, including software, branding, and content provided by Pocket Med, are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

8. Privacy

Your use of the Services is also governed by our Privacy Policy, which describes how we collect and use personal and health-related information.

9. Account Pause and Deletion

You may pause or permanently delete your account as described in our Delete Account Guide. Deletion is irreversible and removes your account and associated data subject to legal retention requirements.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POCKET MED AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

12. Indemnification

You agree to indemnify and hold harmless Pocket Med from claims arising out of your misuse of the Services, violation of these Terms, or infringement of third-party rights.

13. Changes to These Terms

We may modify these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms. We will indicate the date of the latest revision at the top of this page.

14. Governing Law

These Terms are governed by applicable laws in the jurisdiction where Pocket Med operates, without regard to conflict-of-law principles. Disputes will be resolved in the courts of that jurisdiction, unless otherwise required by mandatory local law.
